1. Acceptance of Terms

By accessing or using Sizze ("Service"), operated by Sizze, Inc. ("we", "us", or "our"), you agree to be bound by these Terms of Service. If you do not agree, do not use the Service.

2. Description of Service

Sizze is an AI-powered application builder that enables users to create, deploy, and host web applications through natural language prompts and a visual workspace. The Service includes a web application, macOS application, and iOS application.

3. Accounts

You must create an account to use the Service. You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate and complete information and keep it up to date.

4. Subscriptions & Payments

Sizze offers free and paid (Pro) subscription plans. Pro subscriptions are billed monthly or annually through the Apple App Store or Stripe. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.

Refunds are handled according to Apple's and Stripe's respective refund policies. We reserve the right to change pricing with reasonable notice.

5. Your Content

You retain all ownership rights to the code, assets, and content you create using the Service ("Your Content"). By using the Service, you grant us a limited license to host, store, and process Your Content solely to provide the Service to you.

You are solely responsible for Your Content and ensuring it does not violate any laws or third-party rights.

6. AI-Generated Content

The Service uses AI models to generate code and content based on your prompts. AI-generated output is provided "as is" without warranties of accuracy, completeness, or fitness for a particular purpose. You are responsible for reviewing and testing all AI-generated code before deploying it to production.

7. Acceptable Use

You agree not to:

• Use the Service for illegal purposes or to violate any laws
• Attempt to gain unauthorized access to our systems or other users' accounts
• Interfere with or disrupt the Service or its infrastructure
• Use the Service to build applications that distribute malware or engage in phishing
• Resell or redistribute the Service without our written consent
• Abuse AI features (e.g., prompt injection attacks, excessive automated requests)

8. Hosting & Deployment

Projects are hosted on Sizze infrastructure with a subdomain (yourproject.sizze.io). Custom domains are available on Pro plans. We reserve the right to suspend or remove projects that violate these Terms or consume excessive resources.

9. Limitation of Liability

To the maximum extent permitted by law, Sizze shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including loss of profits, data, or business opportunities, arising from your use of the Service.

Our total liability for any claim related to the Service shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Disclaimer of Warranties

The Service is provided "as is" and "as available" without warranties of any kind, whether express or implied, including implied warranties of merchantability, fitness for a particular purpose, and non-infringement.

11. Termination

We may suspend or terminate your access to the Service at any time for violation of these Terms. You may delete your account at any time. Upon termination, your project data will be deleted after a reasonable retention period.

12. Changes to Terms

We may modify these Terms at any time. Material changes will be communicated via email or in-app notice. Continued use of the Service after changes constitutes acceptance.

13. Governing Law

These Terms are governed by the laws of the State of Delaware, United States, without regard to conflict of law principles.
